Malyia was flown to Stanford University's Lucile Packard Children's Hospital. Doctors there found that Streptococcus A bacteria had invaded her blood and organs, and they performed the amputations.

Court documents show that most of the money will be placed in a trust for Malyia's current needs and an annuity that will provide her with $16,932 a month when she turns 18.

The settlement with the Sacramento hospital and its parent company, Catholic Healthcare West, ranks among the largest in California history, according to personal injury attorneys. Anything less would have eventually put this child on welfare .The burden of her care would be on the taxpayer. But its more than money . Watch for Motorcycles But Not Just in May

May is watch for motorcycles month. There is an increasing awareness on the part of the Department of public safety in Ohio that there are too may motorcycle crashes.

Part of the problem is cagers (car drivers ) not watching the road. A great slogan is BE NICE - LOOK TWICE - WATCH for MOTORCYCLES. Drivers that come to a stop intersection must take their time before pulling out. This is where many of the car motorcycle accidents take place.

Car drivers must realize that the motorcyclist as the bicyclist and even the pedestrian have just as much rights to the road as the car driver. Too many times the car driver says I just did not see the motorcycle. Others will make up the story that the motorcyclist was speeding and was out of my view when I pulled out.

The other piece of the problem is motorcycle riders that are not properly trained. There are still way too many single vehicle motorcycle crashes. So it is imperative to get as much training as possible.

When I got my motorcycle I had someone else drive it home from the dealer . I did not want my first trip to be my last trip as I had just learned to ride a motorcylce through the new rider course on a 250cc. These are much different than those 850cc 750 lb bikes. The last thing you want to do is take out one of those big motorcycles without any practice.

If you have been injured by the fault of another you may not be able to work. One option that should be explored to help you through that period is social security disability. Unfortunetly if your inability to work is short term Social security disability will not help.

The reason is that the test to get social security disability is that you must be disabled for one full year from all employment. So even if you can not do your normal job , but could do another job you can not get social security disability. Nor is there a partial income supplement provision.(However you can still possibly get benefits if you are only able to work part time and gross under $1000 per month)

I just got up and read the article in the Cincinnati Enquirer from the Associated press about gay suicide being caused by bullying. What is it that makes people so mean spirited to make sport of another human being. Just because they are different.

The Washington Post (7/6, Mui) reports Kenneth R. Feinberg, "who was appointed last month by the White House to oversee a claims fund, has said that the biggest challenge to distributing the money -- and avoiding future lawsuits -- is earning the trust of workers in a fiercely independent industry, whose livelihoods have been devastated by the spill. He said on 'Fox News Sunday' that BP had paid out about $130 million so far." But "according to state officials and interviews with residents at the claims center, the most pressing concern was speeding payments to those most affected." The Palm Beach (FL) Post (7/4, Kam, Stapleton) addressed Floridians' frustrations with claims filed.

ABC World News (7/4, story 4, 2:45, Harris) reported, "After saying for weeks that it had plenty of money to deal with the mess, BP now appears to be scrambling to shore up its finances." ABC (Gutman) added, "For about a month now, there's been mounting concern about BP's ability to shoulder those staggering costs of the fines, the claims, and, of course, the cleanup." On Sunday, "we learned that BP is actively searching out for new minority owners and telling its partners in that doomed well to pay up."

NBC Nightly News (7/4, story 5, 2:15, Holt) reported, "So much of the focus has been on the oil spilling for 76 days now, but something else has been spewing from the ocean floor as well, natural gas, and it poses dangers of its own." NBC (Bazell) added, "At the sight, there are huge flames. This is natural gas, mostly methane, recovered with oil and burned off. This oil pool is 40% natural gas and a big question is what is happening to the methane leaking into the ocean." NBC continued, "The answer provided by scientists is that it is staying in the ocean, forming a deep cloud that is destroying the ecosystem. ... Everyone knows the affects of this leak will continue for years and will take much more research like this to figure out what they are."

The Los Angeles Times (7/2, Geiger) reports, that the family of Gordon Jones "and families of the other 10 workers who died when the drilling rig caught fire April 20 off Louisiana want an obscure 1920s statute, the Death on the High Seas Act, changed so they can seek larger damages for the loss of their loved ones. Their lobbying effort on Capitol Hill - led by" Gordon's father Keith, "a Baton Rouge, La., attorney who practically closed his private practice to campaign nonstop - paid off Thursday when the House overwhelmingly passed the legislation the families sought." The bill, which seeks to modify the Death on the High Seas Act, would "allow the families of the workers killed offshore to sue for pain and suffering and loss of care, compassion and comfort." But "as the families and their advocates turn their attention to the Senate, they will face a coalition of powerful and savvy lobbyists led by international cruise-line businesses, the U.S. Chamber of Commerce and the oil industry."

The Washington Post (7/2) says in an editorial that Attorney General Holder's public acknowledgment that the Justice Department had opened a criminal investigation surrounding the Gulf of Mexico oil spill and his later role "in a White House meeting with BP officials about a multibillion-dollar victims' compensation fund" are "discomfiting." A week before Holder's public remarks, Assistant Attorney General Ronald Weich said in a letter to Sen. Barbara Boxer "that 'consistent with long-standing policy, we neither confirm nor deny the existence of such an investigation.' There are sound reasons for this general rule, not least of which is to prevent innocent people from being sullied."

USA Today (7/2, Levin) reports, "The Gulf of Mexico oil spill may have become the largest peacetime oil discharge into the world's oceans, according to government estimates of the massive disaster." The AP (7/1, Breen) says based on "some government estimates, more than 140 million gallons of crude have now spewed from the bottom of the sea" since April 20, "eclipsing the 1979-80 disaster off Mexico that had long stood as the worst in the Gulf."

All three broadcast networks noted the milestone in their coverage of the spill Thursday evening. ABC World News (7/1, lead story, 2:55, Sawyer) reported, "On Day 73, it is now officially the largest oil spill ever in the Gulf of Mexico, now nearly the size of Tennessee." The CBS Evening News (7/1, story 4, 2:25, Pelley) reported, "It is now clear, by the most conservative estimate, the disaster is the largest oil spill accident in human history. There was a larger spill in the Persian Gulf during the 1991 war, but that was unleashed on purpose by Saddam's army. This spill continues to grow in the Gulf of Mexico, by more than one million gallons every day." NBC Nightly News (7/1, story 3, 2:35, Curry) reported, "Today the BP disaster became one of the worst oil spills in the world. According to estimates, more than 140 million gallons have now spewed into the Gulf."

So when big industry talks about caps on damages or the charlatan politicos that advance the interests attempto put them into law turn them back. Now is the time to get all caps on damages removed. let the civil and criminal justice system work. And may the wrongdoers makeup , if they can , with full compensation unrestricted by artificial caps.

Toyota has at least 3 recalls of their cars since 2007 involving the issue of unintended acceleration. The first recall was in 2007 involving an all weather floormat holding the gas pedal in the acceleration mode. Even if your client gets better after one full year they can still get a closed period. They key is that they must not be able to work for one full year.

Don't Use the Simplicity Baby Cribs They Are Killing Babies

Wrongful Death caused by Baby Cribs

Despite several recalls and warnings, the number of reported baby deaths linked to defective Simplicity cribs is now up to 11.

The most recent death occurred in September when a 7-month-old child from Princeton, Ky., became entrapped in the crib when a part of it broke, said the Consumer Product Safety Commission on Thursday.

The agency also said there are another 25 incidents involving drop-side parts detaching from Simplicity cribs.

Simplicity-manufactured cribs recall began in December 2005. More than 2 million Simplicity drop-side cribs have been recalled so far because of problems with their plastic hardware. Some of the recalled cribs have the Graco logo and Winnie the Pooh motif.

The crib hardware can break or deform, causing the drop side to detach. This detachment creates a space between the drop side and crib mattress that babies can roll into and become entrapped, leading to suffocation risk.

The agency has previously announced that a 9-month-old child and a 6-month-old child had died when the drop side was installed upside down. The agency had also announced the death of an 8-month-old child from Houston who became entrapped and suffocated between the drop side and the crib mattress when a plastic connector on the drop side broke.

The agency announcement on Thursday that 11 babies have died was up fromearlier recall announcements that reported only three baby deaths.

The agency says caregivers should check their cribs to see whether they have a recalled Simplicity crib. If they do, consumers should stop using them immediately and should not attempt to fix them.

The crib plastic hardware can break or deform, causing the drop side to detach. When the drop side detaches, it creates space between the drop side and the crib mattress. Infants and toddlers can roll into this space and become entrapped which can lead to suffocation.

As a solo practioner I often notice tv commercials of attorneys huckstering for clients. I often wonder if the clients gets much contact from those offices with a senior trial attorney. I received a call at 7 AM this morning asking whether I was Walmart. I politely told the caller, after rubbing the sleep out of my eyes that she was calling an attorney's office and not Walmart. When I finally awoke, I questioned why this woman would think that I was Walmart.

I don't have a big-box store-front office. I don't discount my fees. I don't offer sales on goods and services. I don't advertise on TV, and I don't have thousands of customers pouring in and out of my parking lot on a daily basis.

As a solo practitioner, I have the benefit of knowing every detail of every case I handle.
As a solo practitioner, I don't have to ask three associates what was the last thing that happened on your case, when you call asking for information.
As a solo practitioner, I have the privilege of meeting you at your very first office visit.
I have the privilege of being with you when you are questioned at your question and answer session, known as a deposition. I also have the privilege of representing you at trial.

There are many large law firms in New York that are set up differently. The attorney you first meet with may not be the attorney who handles your deposition. The attorney you call to get an update may not be the same lawyer that you met on your first visit. The attorney who handles your deposition may not be the trial attorney who tries your case. There are some law firms that have attorneys dedicated to the pretrial phase of your case, and those lawyers do not try cases. Likewise, those law firms may have teams of dedicated trial lawyers, where all they do is try cases.

I personally found, in almost 21 years in practice, that clients love continuity.

Clients like to know that if they have a question, they can go directly to their point person at the lawyer's office to ask them a question or address any concerns they have. No one likes to be shuffled around from one person to the next. However, the question I always ask is "Do you want to deal with the senior trial attorney from day one?" or "Do you want to go to a large firm with many attorneys to handle your case where you may not speak to the actual trial lawyer until shortly before trial?" The choice, as always is yours to make. Choose wisely.

Tort Reform Debate about Healthcare Hurts Patients

Dr Arnold Wax a medical oncologist in Nevada authored an article about the negative effects tort Reform had on a patient. Coupled with the writings of Dr parikh that heath care costs are not down in states with damage caps goes a along way to destroy the myths of tort reform

Dr Wax was active in getting malpractice caps in Nevada. However he tells a story how it backfired on a personal injury victim of a doctors negligence.
In 2002, a nice woman we'll call Mary was referred to Dr. Wax.. Two years earlier, she had developed a skin lesion on her pubic area, which her family physician removed and a pathologist diagnosed as a dysplastic nevus. The margins were cleared, and Mary went on her way.

In 2004, the lesion recurred and her FP again removed it. This time it was malignant. Mary was then referred to a general surgeon for a wide excision and primary closure. Because of the lesion's proximity to lymphatics, Dr Wax requested a lymphoscintigram and a sentinel lymph node biopsy. The surgery was completed and, much to my surprise and chagrin, the lymph node biopsy was positive for melanoma.

Mary was an active person who needed to be fully ambulatory to keep her job and help care for her grandchildren. With this in mind, we discussed the possibility of an inguinal lymph node dissection. But because the surgical complications would interfere with her ability to make a living, she declined.

After a negative staging workup, Dr Wax discussed her other options: observation, clinical trial, or interferon therapy. Mary wanted to treat her disease, so she passed on watchful waiting. Likewise, participating in a clinical trial was out of the question, because she'd have to leave town to be treated. That left interferon therapy, which she agreed to.

In the interim, a second pathologist reviewed Mary's original report from 2002 and found the results were consistent with a diagnosis of malignant melanoma, not a dysplastic nevus. Shortly thereafter, the original pathologist admitted that he'd misread the slides.

Then came the interferon therapy, complete with the expected side effects—fever, chills, sweats, fatigue, and depression. Mary's health declined to the point where she had to take a leave from work. She also developed an unexpected side effect: marked liver function abnormalities, which led to profound weight loss. The interferon was stopped, but the abnormalities persisted. A liver biopsy was performed, and Mary was found to have an autoimmune hepatitis, unmasked but not caused by the interferon. Plans for further therapy were abandoned and, in time, her liver problems resolved.

As Dr Wax writes he expected, Mary sued the pathologist who had misread the original biopsy. Soon after, one of her attorneys asked dr Wax to serve as an expert witness in the case. As her treating physician, he felt a moral obligation to support Mary's claim. Her lawyer said she was asking only for damages to help provide for her grandchildren—which ultimately became more important when her husband died unexpectedly from a post-surgical pulmonary embolus.

It appeared that the case would be resolved quickly, considering that the defendant freely admitted his error. However, this turned out to be far from true.

Affidavits were submitted and depositions taken, including his. With the comments and bare facts now available, the case went to trial. While this easily could have been a $1 million-plus case, tort reform in Nevada meant Mary couldn't receive more than $350,000 in noneconomic damages (pain and suffering) or any collateral source payments. The value of Mary's medical costs, which exceeded $100,000 and were covered by insurance, wouldn't be included in any award.

The trial lasted six days. Dr Wax was on the witness stand for two hours for direct and cross examination. he stated that described the statistical decrease in Mary's five-year survival, as well as all treatment variations between the different stages of melanoma. He also stated that he thought the pathologist's admission of his mistake was "honorable."

As he expected, the jury found the original pathologist negligent. But, to his surprise, Mary wasn't awarded any damages. One of her attorneys later told him that the jury wanted to pin an award on the pathologist's professional corporation, but it hadn't been named in the suit. The jurors reasoned that the pathologist had not acted maliciously, and that if he were found liable for a monetary award, he might leave the state. They were likely influenced by political ads that ran during the state's tort reform ballot campaign, describing physicians who were leaving Nevada because of its malpractice crisis.

The trial judge was incensed by the verdict, because the jury didn't follow the legal standard that should have been applied in the case. Dr Wax was later informed that the defense attorneys planned to go after Mary for court costs, something that the judge vowed he'd never let happen.

Today, Mary is a widowed grandmother, caring for her grandchildren with few resources—injured, admittedly, by a physician's error. She's been off of all therapies since the interferon, which proved successful. But if her melanoma recurs, it will likely be fatal.

Dr Wax stated that when he helped spearhead the tort reform movement in Nevada, he didn't foresee the unintended consequences of innocent, truly injured individuals not receiving their rightful awards due to jurors' misguided emotions.

So jurys do not always get it right,. And in fact in more that 2/3 of cases the plaintiff looses. Not because of a frivolous lawsuit , but because juros still see doctors as white nights and tort reform propganda has seeped into their thinking.

Shakespeare's famous line "kill all the lawyers" is an overstatement of course. But its trendy to put down the trial lawyers in their "tassled shoes" as the reason for society's ills from the high cost of medical care to the leaving of industry from a state.

As a personal injury trial lawyer myself, although I do not handle medical malpractice cases, it may sound like I'm beating my own drum when I say there is no real evidence that "frivolous lawsuits" are many in number and certainly frivolous or not lawsuits do not effect the price of healthcare.

Their refrain is familiar to anybody following the healthcare reform debate. The only problem is that it's not true. There's nothing "sure or quick" about changing medical liability laws that will improve healthcare or its costs. Defensive medicine adds very little to healthcare's price tag, and rising malpractice premiums have had very little impact on access to care."

First the doctor took a look at the statistics and found that they did not support such a claim.

After looking at the statistic on claims the doctor took on the notion of frivolous lawsuits . "Tort reformers push the notion that junk lawsuits dominate the legal system. Studies that show that 80 percent of claims are settled without payment to the patient and that when a case does make it to trial, doctors win 89 percent of the cases."

. Researchers from Harvard published a study in the New England Journal of Medicine that was designed to avoid the limits, and the biases, of prior research. What they found kills the notion of frivolous lawsuits. It suggests that most people who sue are suing for good reason.

Instead of a swamp of frivolous lawsuits, what the data shows is a system that functions. Insubstantial claims tend to collapse, while the medical industry usually opts to pay off injured patients instead of going to trial. The doctors and the insurers choose to fight to win when they think they can, and when there is enough money at stake, and usually do win.

Finally lets deal with the last two arguements the insurance industry uses. The first is that defensive medicine drives up the cost of care. The second is that skyrocketing malpractice premiums are driving doctors out of business, cutting patients' access to care. In both cases, however, the facts don't substantiate those claims.
"Recent analyses show that the effect of defensive medicine on costs is marginal.
Another study concluded that "Direct reforms (caps on damages, abolition of punitive damages, eliminating mandatory prejudgment interest, and collateral source offset) did not significantly reduce payments for Medicare-covered services."

The Congressional budget office also took a hard look at the claim that rising malpractice premiums were driving doctors out of business and thus cutting access to care. While the report did find instances of reduced access to emergency surgery and newborn delivery, albeit in scattered, often rural, areas, it also found that many reported shortages of healthcare providers could not be substantiated or did not widely affect access to healthcare. Traditionally, rural areas are where healthcare is scarce anyway.

The doctor made a telling conclusion about what is really behind the rise in premiums citing the need for insurane companies to make a buck.

"It would seem that after all of this, what we are left with is a crisis not of the medical-legal system, but of the economics of malpractice insurance, as doctors have seen their premiums skyrocket in recent years. But even that can not be pinned strictly on the risk of insuring physicians. Public Citizen, a consumer advocacy group, notes "that a historical pattern has been established that insurance rates rise also based on the investment market ... Earlier 'crises' similar to todays 'crisis' were due to declining investment fortunes and failed pricing practices of the insurance industry rather than an increase in medical malpractice filings and awards. Then, as now, the insurance industry covered its losses by raising rates dramatically, then blamed the lawyers of innocent patients rightfully seeking compensation for negligence-related injuries."

Tort reform is not going to save one extra life. Plus it will place the cost of wrongly injured people onto the taxpayer. Why not look for ways to help doctor, hospitals and nurses to prevent medical mistakes.
