Cincinnati personal injury lawyer Smoke Detector Safety injury Alert

As a Personal injury lawyer I have handeled several burn injury cases. The most recent one dealt with a defective or non working smoke detector. I learned during the investigation of that personal injury claim that there are two kinds of detectors.

On is ionic which is more of a "flame catching" fire and the other is photoelectric which picks up smoke before it becomes lethal.  You could have an ionic detector and it could not go off during a smouldering fire. When you buy them look for the p for photoelectric and the i for ionic. Some governments are rewriting laws to make the photo electric mandatory. My suggestion is use both .

It is important in any fire case to have the scene preserved so you can can hire your own expert to do an investigation. Often there is dispute as to the cause and origin of the fire. In cases where there is a possibility that the smoke detector did not go off the smoke detector should be preserved. There could be many reasons for the smoke detector to have failed to sound.

The City of Cincinnati has their own ordinance regarding the duties with respect to a smoke detector in the landlord tenant house or apartment fire. The Landlord must supply working smoke detectors. The tenant has responsibility to check the smoke detector to be sure it is working. And if it is not they should call the landlord right away and in the meantime get a new battery to see if it fixes the problem .

Chances are the smoke detectors that
are in your home are classified as ionization detectors.
  Homeowners  have
long been protected by these detectors
as they have become more prevalent
and more affordable in today’s market.
When you experience a fire in your
home you want to be alerted quickly in
order to safely extinguish or evacuate
the home before you succumb to
smoke and other poisonous gases.
Most residential fires start out as smoldering fires
that create a low temperature smoke.
Photoelectric Smoke Detectors can activate significantly faster
than ionization smoke detectors giving
you the added time you need to react
to the fire.  During smoldering fires, the
Photoelectric Smoke Detector activated between 12 and 30 minutes
quicker than the ionization smoke detector.
A study conducted by Texas A&M University
 found that the failure rate of
ionization smoke detector during a
smoldering fire was 55%.  Photoelectric
Smoke Detectors had just a failure rate
of 4% under the same conditions.
If you received a free smoke detector
from the fire department or the American Red Cross
within the last decade,
you are using an ionization smoke detector.
 Although having an ionization
smoke detector is better than not having one,
the fire department stands
behind the research being conducted
and recommends that the community
add Photoelectric Smoke Detectors to
their homes.

chose the detector that has been
shown to alert faster under smoldering fire conditions .  Photoelectric
Smoke Detector can be found  at
many local retailers.  Please check the
box and make sure it says Photoelectric or has the symbol (P)."
