Cincinnati Personal Injury Lawyer on being a Trial Lawyer
As a Cincinnati Personal Injury Lawyer I thought there may be some interest for people hurt in car accidents or other personal injuries to learn how a trial works. It was of interest where I read in this morning's Cincinnati Enquirer about a criminal defense attorney who said, "I eat stress for breakfast."
The life of a trial lawyer criminal or civil is stressful. There is a lot on the line in terms of money and the future of your client. But winning a jury trial is one of the happiest things that can occur in my profession. It's a heck of a lot of work. What people don't see is the tremendous amount of preparation that goes into a trial.
There are several big differences though between a civil and criminal trial. Since I represent the person injured in a civil trial I have the burden of proof to prove my case. A criminal defense attorney does not.
The burden of proof in a civil personal injury case is by a preponderance of the evidence, what's more likely than not. In a criminal case the State has the burden of proof beyond a reasonable doubt.
